Please read the following terms and conditions (Terms of Use) carefully as they govern your use of this Website.  By accessing the website www.bnsw.com.au (Site) operated by Basketball New South Wales (ABN 98 003 359 680) (we, us and our), you agree to these Terms of Use and our Privacy Policy available here.

Acceptance

  1. By using our Site, you confirm that you accept these Terms of Use and that you agree to comply with them.  If you do not agree to these Terms of Use, you must not use our Site.
  2. You agree that further terms and conditions apply to your use of Basketball NSW software platforms (the Platforms and the Platform Terms).  
  3. In the event of any inconsistency between the provisions of these Terms of Use and the Platform Terms, you accept that the Platform Terms will apply to the extent of the inconsistency unless we specifically agree to the contrary with you in writing.

  1. We amend these terms from time to time. Every time you wish to use our Site, please check these terms to ensure you understand the terms that apply at that time.

5. We may update and change our Site from time to time to reflect changes to our products and services, our users’ needs and our business priorities.

6. Our Site is made available free of charge.

7. We do not guarantee that our Site, or any content on it, will always be available, uninterrupted or be error-free.

8. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons.

Eligibility to use our Site

10. Our Site is directed to users who are residing in and using this Site within Australia.  We do not represent that content available on or through our Site is appropriate for use or available in other locations.  

11. If you access our Site from outside Australia, you do at your risk and you are responsible for compliance with laws applicable to your accessing the Site from your location.

Account details

12. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

13. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

16. Our status (and that of any identified contributors) as the authors of content on our Site must always be acknowledged.

17. You must not use any part of the content on our Site for commercial purposes without obtaining a licence to do so from us or our licensors.

18. If you print off, copy or download any part of our Site in breach of these Terms of Use, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

19. If we provide social media features such as the ability to share content, you may take such actions as are enabled by such features.

20. You must not delete or alter any copyright, trade mark or other proprietary rights notices from copies of materials from this Site.

Content standards

21. Content standards apply to any and all contributions (if permitted) uploaded to the Site by users (User Contributions).  User Contributions must in their entirety comply with all applicable federal, state, local and international laws and regulations.

22. In particular, you warrant that your User Contributions will not:

     (a) contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable; 

     (b) contain or promote sexual or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

     (c) infringe any patent, trade mark, trade secret, copyright or other intellectual property or other rights of any other person;

     (d) violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use;

     (e) be likely to deceive any person;

      (f) promote any illegal activity, or advocate, promote or assist any unlawful act;

      (g) cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;

      (h) impersonate any person, or misrepresent your identity or affiliation with any person or organisation, including with us;

       (i) involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising; or

       (j) give the impression that you emanate from or are endorsed by us or any other person or entity, if this is not the case.

23. Whenever you make use of a feature (if any) that allows you to upload content to the Site, or to make contact with other users, you must comply with the content standards in paragraph 22.

24. You warrant that any such contribution complies with the standards in paragraph 22, and you will be liable to us and indemnify us for any breach of that warranty.  This means that you will be responsible for any loss or damage we suffer as a result of your breach of warranty.  We may report any breach of your warranty to the relevant law enforcement authorities and we will cooperate with those authorities by disclosing your identity to them.  In the event of such a breach, your right to use our Site will cease immediately.

Your visit to our Site

Australian law
